The Math Revolution service (collectively, “Math Revolution”, “the Site”, “the Service” or “We”) is operated by Global Education Monster Corp. By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Service, all of its applicable laws and regulations. You are also agreeing that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trademark law. At all times, you are bound by the then-current version of this Agreement and all applicable laws. We highly recommend that you review this Agreement from time to time to ensure that you are familiar with the most recent version. These Terms of Use are effective as of April 1, 2015. We expressly reserve the right to change these Terms of Use from time to time without notice.

1. User's Acknowledgment and Acceptance of Terms


Math Revolution provides the www.mathrevolution.com site and services (collectively, the "Site" or the “Service”) to you, the user, subject to your compliance with terms, conditions, and notices contained or referenced herein (the "Terms of Service") In addition, when using particular services or materials on this Site, users shall be subject to any posted rules applicable to such services or materials that may contain terms and conditions in addition to those in these Terms of Use. All such guidelines or rules are hereby incorporated by reference into these Terms of Use.

By using this site, you agree to be bound by these terms of service. If you do not wish to be bound by these terms of service, please exit the site now. Your remedy for dissatisfaction with this site, or any products, services, content, or other information available on or through this site, is to stop using the site and/or those particular products or services. Your agreement with us regarding compliance with these terms of service becomes effective immediately upon commencement of your use of this site.

As used in these Terms of Use, references to our "Affiliates" include our owners, subsidiaries, affiliated companies, officers, directors, suppliers, partners, sponsors, and advertisers, and includes (without limitation) all parties involved in creating, producing, and/or delivering this Site and/or its contents.

2. Eligibility


In compliance with the Children's Online Privacy Protection Act, Math Revolution does not permit children under 13 years of age to become users without their parent or guardian's express consent and approval. By using our Site, you represent you are not under 13 years of age or have had your parent or guardian give their personal information in lieu of giving yours. No part of Math Revolution’s web site is structured to serve or attract anyone under the age of 13.

3. Registration Data; Account Security


If you subscribe to any of Math Revolution’s services, you will have an account and a password. Access to password protected portions of this Site is available for only so long as you have paid all required fees to Math Revolution. You are responsible for maintaining the confidentiality of your account and password and for restricting access to Math Revolution material to anyone other than yourself. You agree to accept responsibility for all activities that occur under your account or password. Math Revolution reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.

4. Use License


Math Revolution owns or has rights to use all of the data, information, text, images, and other content contained on the Website, and the copyrights and other intellectual property rights therein, unless otherwise noted. Permission is granted to a terminable non-exclusive, non-transferable license to use Math Revolution's web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials

  • Use the materials for any commercial purpose, or for any public display (commercial or non-commercial)

  • Attempt to decompile or reverse engineer any software contained on Math Revolution’s web site.

  • Remove any copyright or other proprietary notations from the materials or

  • Transfer the materials to another person or "mirror" the materials on any other server.


This license will automatically terminate if you violate any of these restrictions and may be terminated by Math Revolution at any given time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

5. Warranties and Disclaimers


The materials on Math Revolution’s web site are provided as is. Math Revolution makes no warranties, expressed or implied, and disclaims and negates all other warranties, including without limitation to, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Math Revolution does not warrant or make any representations concerning the accuracy, likely results , or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

Math Revolution and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors make no warranty that (i) the service will meet your requirements ; (ii) the service will be uninterrupted, timely, secure or error-free; (iii) the results that may be obtained from the use of the service will be accurate or reliable ; (iv) the quality of any products, services, information or other material purchased or obtained by you through the service will meet your expectations; and (v) any errors in the software will be corrected.

The Service may be temporarily unavailable for maintenance or other reasons. Math Revolution assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, communications.

Under no circumstances will Math Revolution be responsible for any loss or damage, including any loss or damage to any User Content or personal injury or death, resulting from anyone's use of the Site or the Service, any User Content or Third-Party Applications, Software or Content posted on or through the Site or the Service or transmitted to Users, or any interactions between users of the Site, whether online or offline.

6. User Content


You understand that except for advertising programs offered by us on the Site, the Service and the Site are available for your personal, non-commercial use only. You represent , warrant and agree that no materials of any kind submitted through your account or otherwise posted, transmitted, or shared by you on or through the Service will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libelous, defamatory or otherwise unlawful material.

You are solely responsible for the photos, profiles, messages, notes, text, workbook, PDF information and other content that you upload, publish or display (hereinafter, "post") on or through the Service or the Site, or transmit to or share with other users (collectively the "User Content"). You may not post, transmit, or share User Content on the Site or Service that you did not create or that you do not have permission to post. You understand and agree that Math Revolution may, but is not obligated to, review the Site and may delete or remove (without notice) any Site Content or User Content in its sole discretion, for any reason or no reason, including without limitation User Content that in the sole judgment of Math Revolution violates this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of users or others. You may remove your User Content from the Site at any time. If you choose to remove your User Content, the license granted above will automatically expire, however you acknowledge that the Company may retain archived copies of your User Content.

7. User Conduct


Your use of the Site is subject to all applicable laws and regulations. Without limitation, you agree to not do following while using the Site:

1. Use any automated device, spider, robot, crawler, data mining tool, software or routine to access, copy, or download any part of

the Site unless expressly permitted by the Site.


2. Gain or attempt to gain unauthorized access to non-public areas of the Site and/or attempt to or override any security

component included in or underlying Math Revolution.


3. Attempt to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to

the website, overloading, "flooding", "spamming", "mailbombing" or "crashing", sending unsolicited e-mail, including promotions

and/or advertising of products or services.


4. Attempt to decipher, decompile, disassemble or reverse engineer any of the content comprising or in any way making up all or

any part of the Site; modify any meta data, copy or duplicate in any manner any of the content; framing of or linking to any of the

Site, its content or information available from the Site without the express written consent of agents of the Site; access the

Service via automated or manual means or processes if you are a direct or indirect competitor of and are using the Service for

purposes of monitoring its availability, performance or functionality, or for any other benchmarking or competitive purposes in

order to build a competitive product or service and/or build a product using similar ideas, features, functions or

graphics of the Service.


5. Infringe on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right.


6. Distribute or otherwise commercially exploit or make available to any third party the Service, or any part thereof, in any way.


7. Use or attempt to use another's account without authorization from Math Revolution


8. Share your email address, nickname and password to any third party at any time for any reason.


9. Involuntarily collect information about others, including but not limited to members’ e-mail addresses;


10. Reverse engineers or decompiles the software comprising the Website.


You agree that we may at any time, and at our sole discretion, terminate your account or other affiliation with our Site without prior notice to you for violating any of the above provisions. In addition, you acknowledge that we will cooperate fully with investigations of violations ofsystems or network security at other sites, including cooperating with law enforcement authorities in investigating suspected criminal violations.

8. Limitation of Liability


In no event shall Math Revolution or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Math Revolution’s Internet site, even if Math Revolution’s authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you. This limitation shall apply not withstanding any failure of essential purpose of any limited remedy.

9. Revisions and Errata


The materials appearing on Math Revolution's web site could include technical, typographical, or photographic errors. Math Revolution does not warrant that any of the materials on its web site are accurate, complete, or current. Math Revolution may make changes to the materials contained on its web site at any time without notice. Math Revolution does not, however, make any commitment to update the materials.

10. Links from Website


Links provided from the Website to other websites or Internet locations are provided for the convenience of Math Revolution’s members. Math Revolution does not endorse, sponsor, or approve, of any content of such websites or locations. Math Revolution has no control over any of the websites or Internet locations that you may access through the Website, and is not responsible for the content or accuracy of the content of any such website or location. If you access any other website or Internet location through the Website, you do so at your own risk. If you believe that any link on the Website leads to an illegal, offensive, or inappropriate website, please send an email to info@mathrevolution.com.

11. Proprietary Rights


You acknowledge and agree that the Service and any necessary software used in connection with the Service contain proprietary and confidential information that are protected by applicable intellectual property and other laws. You further acknowledge and agree that content contained in information presented to you through the Service is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws.

12. Indemnification


Upon request, you agree to defend, indemnify, and hold us and our Affiliates harmless from all liabilities, claims, and expenses, including attorney’s fees that arise from your use or misuse of this Site. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

13. Entire Agreement


The Terms and Conditions of Service govern your use of the Service and constitutes the entire agreement between you and Math Revolution. It supersedes any prior agreements between you and Math Revolution. Additional terms and conditions may apply when you use the services of service providers and others. These additional terms will not reduce, diminish, or eliminate any rights Math Revolution possesses with respect to these Terms and Conditions of Use.

14. Miscellaneous


In any action to enforce these Terms of Use, the prevailing party will be entitled to costs and attorneys’ fees. Any cause of action brought by you against us or our Affiliates must be instituted with one year after the cause of action arises or be deemed forever waived and barred. You may not assign your rights and obligations under these Terms of Use to any party, and any purported attempt to do so will be null and void. We may free assign our rights and obligations under these Terms of Use. If any part of these Terms of Use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect. Any failure by us to enforce or exercise any provision of these Terms of Use or related rights shall not constitute a waiver of that right or provision. In the event that Math Revolution or, substantially all of its assets, is acquired by one or more third parties as a result of an acquisition, merger, sale, reorganization, consolidation or liquidation the information we collect on our Site may be one of the transferred assets.

15. Subscription Period


You will be entitled to receive the Service only during the subscription period ("Subscription Period") specified by your payment confirmation.

16. Payment Terms


Within 7 days, upon request by e-mail, a full refund is provided. A refund is not provided after the 7 day period.

To request a refund, please contact us at (info@mathrevolution.com) and we’ll gladly refund you the full amount. Math Revolution asks that you briefly explain the reasons for doing so, as well as provide any suggestions regarding how Math Revolution can improve its services. Refunds will be made to PayPal account that was used to make the purchase.

Payment is made by credit card.

Purchased lectures may be in immediate use or PDF format workbooks may be available for downloads once payment is in full. No delivery of tangible products including books, CDs, etc. take place during or after transaction.

17. Waiver and Severability of Terms


The failure of Math Revolution to exercise or enforce any right or provision of the Terms and Conditions of Use shall not constitute a waiver of such right or provision. If any provision of the Terms and Conditions of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms and Conditions of Use remain in full force and effect.

18. Electronic Communications


When you visit this website and when you communicate with us electronically, for example by sending us an email or ordering our products online, you consent to receive communications from us electronically. We will communicate with you by email or by posting notices on this website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

19. Privacy Policy


You consent to the collection, processing and storage by Math Revolution of your personal information in accordance with the terms of Math Revolution’s Privacy Policy. You agree to comply with all applicable laws and regulations, and the terms of Math Revolution’s Privacy Policy, with respect to any access, use and/or submission by you of any personal information in connection with this web site.

20. Description of Service


We produce online/video-based GMAT preparation courses on this Site. Permission is granted for a 3/6/12-month period to access the Math Revolution website for personal, non-commercial transitory viewing only. A-La-Carte is a 3-month course. This is a non-exclusive, non-transferable, non-sublicenseable revocable, limited license to access the Service for the user’s personal and non-commercial use and is not a transfer of title. You are responsible for providing, at your own expense, all equipment necessary to use the service, including a computer, modem, and Internet access (including payment of all fees associated with such access). We reserve the sole right to either modify or discontinue the Site, including any of the Site’s features, at any time with or without notice to you. Any new features that augment or enhance the then-current services on this Site shall also be subject to these Terms of Use.

21. Submitted Materials


Subject to our Privacy Policy, any communication or material that you transmit to this Site or to us, whether by electronic mail, post, or other means, for any reason, will be treated as non-confidential and non-proprietary. While you retain all rights in such communications or material, you grant us and our agents and affiliates a non-exclusive, paid-up, perpetual, and worldwide right to copy, distribute, display, perform, publish, translate, adapt, modify, and otherwise use such material for any purpose regardless of the form or medium (now known or not currently known) in which it is used.

22. Termination of Use


You agree that we may, in our sole discretion, terminate or suspend your access to all or part of the Site with or without notice and for any reason, including, without limitation, breach of these Terms of Use. Any suspected fraudulent, abusive or illegal activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities.

Upon termination or suspension, regardless of the reasons therefore, your right to use the services available on this Site immediately ceases, and you acknowledge and agree that we may immediately deactivate or delete your account. We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by us in connection with such termination or suspension.
